RESOLUTION
DIRECTING THE COMMITTEE ON HOUSING AND URBAN DEVELOPMENT TO CONDUCT AN INQUIRY, IN AID OF LEGISLATION, ON THE VIOLENT DEMOLITION OF HOUSES OF AROUND 300 FAMILIES RESIDING IN BRGY. 8, CALOOCAN CITY WHICH RESULTED TO ALLEGED CASES OF HUMAN RIGHTS VIOLATIONS COMMITTED BY THE CALOOCAN CITY POLICE AND
PRIVATE CLAIMANT MR. ERNESTO BAELLO

WHEREAS, Article II Section 1 of the 1987 Constitution provides that “no person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied equal protection of the laws”;

WHEREAS, Article XIII Section 10 of the 1987 Constitution further provides that “urban or rural poor dwellers shall not be evicted nor their dwellings demolished, except in accordance with law and in just and humane manner. No resettlement of urban or rural poor dwellers shall be undertaken without adequate consultation with them and the communities where they are to be relocated”;

WHEREAS, United Nations Declaration of Human Rights recognizes that “everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services…”;

WHEREAS, Mr. Ernesto Baello, claims ownership of the property located in Block 51 Phase 3 F2, Brgy. 8, Caloocan City;

WHEREAS, in 1983, said property was awarded by the National Housing Authority (NHA) to informal settlers, and the recipients have been residing in the area ever since and have been paying for “Rights”;

WHEREAS, the residents of said area have made payments to and are still paying for the “Rights” at the NHA;

WHEREAS, the City Government of Caloocan issued a demolition notice on 23 June, 2016. Consequently, the residents immediately put up a barricade to protect their homes;

WHEREAS, on 27 June, 2016, Caloocan City Police numbering 200 along with 100 personnel of Special Weapons and Tactics accompanied by 100 members of the demolition team arrived on the area;

WHEREAS, on the same date, the demolition started even without negotiations between the police and the local leaders of the residents;

WHEREAS, during the demolition, policemen grabbed and beat random residents present on the barricade, arresting two, one being a minor;

WHEREAS, according to the residents, a total of two tear gas canisters were fired upon them, as well as 16 shots from firearms;

WHEREAS, the following human rights violations were allegedly inflicted upon the residents, to wit: violation of the right of domicile, illegal arrest and detention, violation against right to free speech and assembly, physical assault, and indiscriminate firing;

WHEREAS, said incident left 300 families homeless; furthermore, since the claimant of the land is a private entity, no relocations were allotted to the resident;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, THAT COMMITTEE ON HOUSING AND URBAN DEVELOPMENT CONDUCT AN INQUIRY, IN AID OF LEGISLATION, ON THE VIOLENT DEMOLITION OF HOUSES OF AROUND 300 FAMILIES RESIDING IN BRGY. 8, CALOOCAN CITY WHICH RESULTED TO ALLEGED CASES OF HUMAN RIGHTS VIOLATIONS COMMITTED BY THE CALOOCAN CITY POLICE AND PRIVATE CLAIMANT MR. ERNESTO BAELLO
